Law center helps defend open source

Eben Moglen, Columbia University Law Professor, will head the newSoftware Freedom Law Center (SFLC). An initial 4 million dollars has been provided by Open Source Development Labs (OSDL) to fund the project.

The law center will provide free legal service for open source projects and developers. In 2004 OSDL established a separate $10 million Linux Legal Defense Fund providing legal support for Linus Torvalds, Linux kernel creator and end user companies subjected to Linux-related litigation by the SCO Group. The new law center will not be affiliated with the OSDL.

“This is about taking care of the goose that laid the golden egg and not letting wolves come in the middle of the night and steal it away,” Moglen said during a press conference. “This is a legal firm not involved so much in litigating and defending as it will be for counseling and advising and nurturing non-profits and to prevent millions of dollars in litigation.”

Moglen will serve as chairman and director-counsel of the non-profit organization. Also on board as directors are: Lawrence Lessig, law professor at Stanford Law School; Daniel Weitzner, director of the World Wide Web Consortium‘s technology and society activities; and Diane Peters, general counsel at the OSDL. Daniel Ravicher, executive director of the Public Patent Foundation, will help manage as legal director.

Moglen, one of the world.s leading experts on copyright law as applied to software, will run the new Law Center from its headquarters in New York City. The Law Center will initially have two full-time intellectual property attorneys on staff and expects to expand to four attorneys later this year. Initial clients for the Law Center include the Free Software Foundation and the Samba Project.

Other services provided by the SFLC include: asset stewardship, to avoid intellectual property claim conflict; license review and compatibility analysis; legal consulting and lawyer training.

Euro reaches new lows

On Tuesday, the Euro fell to a new record low in relation to the Swiss Franc, and to multi-month lows against the U.S. Dollar and Japanese yen; all considered by investors to be safe currencies during times of economic turmoil.

The Wall Street Journal reported earlier that recent comments from the newly installed head of the International Monetary Fund, France’s Christine Lagarde, resulted in a sell-off of the Euro. At a roundtable discussion in Washington, Lagarde noted that the IMF had not yet reached discussion of terms and conditions of a second Greek bailout plan. In fact, a representative from the IMF is currently meeting with Eurozone policymakers to draft such a new proposal. The yield differential between Italian bonds and German bonds has spread to more than 300 basis points, something not seen in over a decade and evidence of investors’ concern.

Adding to the Euro’s woes is the upcoming release of the bank stress tests on Friday. The European Bankers Association said that they expect the data release to shed new light on the Eurozone’s banking situation. Representatives of several of the Eurozone’s governments, including Germany, have requested that the association consider releasing fewer specific details for fear that investor panic will ensue. The inadequacy of the capitalization rates has been an issue with the European Central Bank, whose president recently called upon Eurozone banks to make every effort to put their balance sheets in order.

For the time being at least, an unsubstantiated rumor reported by the Wall Street Journal states that the Eurozone’s central banks’ purchase of periphery debt has helped to quell the downward momentum of the Euro.

Paul Schäfer, founder of Colonia Dignidad, dies at 88

Paul Schäfer died at 88 from cardiac-respiratory arrest on early Saturday morning in a Chilean prison hospital. Schäfer was the founder and former leader of Colonia Dignidad, an enclave used for torturing and exterminating political prisoners during Augusto Pinochet’s dictatorship. Hr was convicted for sexually abusing 26 children for years, and retained thousands of people under his own tyrannical regime, that worked as an aside territory in the country, where people spoke the German language.

Jorge Zepeda, magistrate who investigated the crimes made in Colonia Dignidad, reported that Schäfer was unconscious when he died. He was to stay in prison for 33 years. Hernán Fernández, one of the lawyers against Colonia Dignidad, said that Schäfer’s death should help to accelerate the judiciary processes. Chilean President Sebastián Piñera said, “Paul Schäfer will be judged by the divine justice.”

Schäfer was born in 1921, in Siegburg, Germany. He was a non-commissioned Nazi officer, who moved to Chile after the Second World War, evading accusations of sexual abuse of minors. He established an organization in a rural area of Chile, in favour of the poor people, located 400 kilometers south of Santiago, to the border of Argentina. He named this place Villa Babiera.

He began his rule of this area in 1961; he established a private tyrannical regime, where almost 300 Germans worked for decades without pay. Men and women were segregated, and people who tried to escape were killed. Adults and children considered it an “honour” for Schäfer to chose to have sex with them.

When Pinochet’s regime ended, Schäfer escaped from Chile in 1996 to avoid being imprisoned, after he came under investigation for human rights violations and abuse to minors. He was detained in Argentina, and then extradited back to Chile in 2005. Since then he was imprisoned. Colonia Dignidad still exists, though without the power they had before, less secluded and with new leaders.

BDSM as business: An interview with the owners of a dungeon

Torture proliferates American headlines today: whether its use is defensible in certain contexts and the morality of the practice. Wikinews reporter David Shankbone was curious about torture in American popular culture. This is the first of a two part series examining the BDSM business. This interview focuses on the owners of a dungeon, what they charge, what the clients are like and how they handle their needs.

When Shankbone rings the bell of “HC & Co.” he has no idea what to expect. A BDSM (Bondage Discipline Sadism Masochism) dungeon is a legal enterprise in New York City, and there are more than a few businesses that cater to a clientèle that wants an enema, a spanking, to be dressed like a baby or to wear women’s clothing. Shankbone went to find out what these businesses are like, who runs them, who works at them, and who frequents them. He spent three hours one night in what is considered one of the more upscale establishments in Manhattan, Rebecca’s Hidden Chamber, where according to The Village Voice, “you can take your girlfriend or wife, and have them treated with respect—unless they hope to be treated with something other than respect!”

When Shankbone arrived on the sixth floor of a midtown office building, the elevator opened up to a hallway where a smiling Rebecca greeted him. She is a beautiful forty-ish Long Island mother of three who is dressed in smart black pants and a black turtleneck that reaches up to her blond-streaked hair pulled back in a bushy ponytail. “Are you David Shankbone? We’re so excited to meet you!” she says, and leads him down the hall to a living room area with a sofa, a television playing an action-thriller, an open supply cabinet stocked with enema kits, and her husband Bill sitting at the computer trying to find where the re-release of Blade Runner is playing at the local theater. “I don’t like that movie,” says Rebecca.

Perhaps the most poignant moment came at the end of the night when Shankbone was waiting to be escorted out (to avoid running into a client). Rebecca came into the room and sat on the sofa. “You know, a lot of people out there would like to see me burn for what I do,” she says. Rebecca is a woman who has faced challenges in her life, and dealt with them the best she could given her circumstances. She sees herself as providing a service to people who have needs, no matter how debauched the outside world deems them. They sat talking mutual challenges they have faced and politics (she’s supporting Hillary); Rebecca reflected upon the irony that many of the people who supported the torture at Abu Ghraib would want her closed down. It was in this conversation that Shankbone saw that humanity can be found anywhere, including in places that appear on the surface to cater to the inhumanity some people in our society feel towards themselves, or others.

“The best way to describe it,” says Bill, “is if you had a kink, and you had a wife and you had two kids, and every time you had sex with your wife it just didn’t hit the nail on the head. What would you do about it? How would you handle it? You might go through life feeling unfulfilled. Or you might say, ‘No, my kink is I really need to dress in women’s clothing.’ We’re that outlet. We’re not the evil devil out here, plucking people off the street, keeping them chained up for days on end.”

Canadian PM cabinet shuffle results

Canadian PM Stephen Harper has shuffled his cabinet today.

The major change with this shuffle is Rona Ambrose, Minister of Environment, being replaced by Treasury Board President John Baird. When a reporter asked her earlier if she would be replaced she replied, “Yes — very excited.” Ambrose is the new intergovernmental affairs minister.

Vic Toews, the justice minister, is now President of the Treasury Board. Rob Nicholson, who was house leader, is now justice minister. Peter Van Loan, who was intergovernmental affairs minister, is now house leader. Monte Solberg, the immigration minister, replaces Diane Finley as Minister of Human Resources and Social Development. Diane Finley, loses the Human Resources portfolio and gets the Citizenship and Immigration ministry.

Six MPs were appointed “Secretary of State” roles, they are junior cabinet ministers. Secretary of States do not make part of the cabinet. These new Secretary of States are :

  • Helena Guergis, MP for Simcoe—Grey, Secretary of State (Foreign Affairs and International Trade) (Sport);
  • Jay Hill, MP for Prince George—Peace River, Secretary of State and Chief Government Whip.
  • Jason Kenney, MP for Calgary Southeast, Secretary of State (Multiculturalism and Canadian Identity);
  • Christian Paradis MP for Mégantic—L’Érable, Secretary of State (Agriculture) and
  • Gerry Ritz, MP for Battlefords—Lloydminster, Secretary of State (Small Business and Tourism);

Marjory LeBreton who was the Leader of the Government in the Senate now also has the role of Secretary of State (Seniors).

The new cabinet still will consist of 27 ministers, 32 if you include the Secretaries.

TGV makes 574.8 km/h on rails

A French Train à Grande Vitesse (High-Speed Train or TGV) has smashed the world record for a train on conventional rails by a big margin, reaching 574.8km/h (356mph) The TGV travelled over 59.8 km/h (36 mph) faster than its previous record of 515 km/h (320 mph)

The record attempt by a modified TGV took place on a track between Paris and the eastern city of Strasbourg. However, this is not the fastest train speed. A Japanese Maglev (Magnetive Levitation Train) reached a top speed of 581km/h (361mph) in 2003. The TGV made history at 13:14 CEST (11:14 UTC). The TGV had been modfied and was called V150 – a TGV with larger wheels than usual and two engines driving three double-decker cars. The vehicle’s horsepower was 25,000.

Reporters said the three train drivers were seen grinning on French TV after they realised they had broken the record. The TGV travelled almost as fast as a World War II Spitfire fighter at top speed. Even the electrical tension in the overhead cable was increased 6000 volts from 25,000 volts to 31,000 for the record attempt.

“We saw the countryside go by a little faster than we did during the tests,” engineer Eric Pieczac said.

“Everything went very well. There are about 10,000 engineers who would want to be in my place,” Mr Pieczac said. “It makes me very happy, a mixed feeling of pride and honour to be able to reach this speed.” Since their introduction in 1981, TGVs generally travel at about 300km/h (187.5 mph) however, on the recently opened Paris-Strasbourg LGV (Ligne à Grande Vitesse or High-Speed line) trains will travel at 320 km/h (200 mph)

SNCF and Alstom – the TGV’s manufacturer – have said that the record test was performed to see how a TGV would react in extreme conditions – conditions that cannot be performed in a laboratory.

After the record was broken, French President Jacques Chirac conveyed his congratulations on “this new proof of the excellence of the French rail industry.” The President also said that “Economically efficient and respectful of the environment, the TGV is a major asset in efforts to ensure sustainable development in transport

“What is important for us today is to prove that the TGV technology which was invented in France 30 years ago is a technology for the future,” said Guillaume Pepy

Alstom plans to increase TGV sales abroad, where it is competing with high-speed trains such as the Japanese Shinkansen and the German ICE. Currently, nations of the Far East such as China, South Korea, Japan and Taiwan are the “top” customers for high-speed trains. Agence France-Presse said that a high-speed rail link in between Los Angeles and San Francisco, California was being looked into.
